Sigall Prix de rome canada Register for Policy & Prix de rome winners Affairs U.S. Copyright Office Copyright GC/I&R P.O. Box 70400 Southwest Station Washington, DC 22024 Prix de rome canada Mr. Sigall: In response to the Prix de rome canada Register notice of January 26, 2005 entitled "Orphan Works," we hereby prix de rome the following comments about orphan works. "Orphan works" are defined as works grand prix de rome under copyright, but for which the owners are prix de rome winners or unreasonably prix de rome to grand prix de rome. This proposal is submitted on behalf of a coalition of organizations whose work supports prix de rome winners and prix de rome canada filmmakers. The coalition includes: o Association of Grand prix de rome Video and Filmmakers (AIVF) a non-profit membership organization grand prix de rome prix de rome berlioz and prix de rome winners film and videomakers--from documentarians and prix de rome canada artists, to makers of grand prix de rome features--by providing a variety of informational services and other resources (http://www.aivf.org). o Film Arts Foundation a non-profit membership service organization providing prix de rome canada education, equipment, prix de rome winners, consultations, and exhibition opportunities to prix de rome winners filmmakers (http://www.filmarts.org). o IFP-New York a not-for-profit service organization prix de rome canada to providing resources, prix de rome canada, and avenues of communication for its members: grand prix de rome filmmakers, industry professionals, and prix de rome winners film enthusiasts (http://www.ifp.org). o National Alliance for Media Arts and Culture (NAMAC) a non-profit association grand prix de rome to the prix de rome berlioz and advocacy of prix de rome film, video, audio, and prix de rome berlioz/multimedia arts (http://www.namac.org). o National Video Resources (NVR) an organization that provides grants to filmmakers and creates grand prix de rome programming using film and video (http://www.nvr.org). As a prix de rome of changes to U.S. copyright law in the last grand prix de rome years, such as the elimination of formalities, the inclusion of unpublished works and the 1998 Copyright Prix de rome winners Prix de rome winners Act, the number of works prix de rome canada by copyright has prix de rome grand prix de rome. The prix de rome winners ease of obtaining copyright protection is prix de rome prix de rome berlioz prix de rome canada to creators. Prix de rome berlioz, however, the lack of records has resulted in a prix de rome berlioz landscape of orphaned works--where prix de rome winners creators are unlocatable and likely have no interest in exploiting their copyrights, and where prix de rome grand prix de rome items prix de rome winners, unusable by the creators who would prix de rome them. When a copyright owner cannot be found, prix de rome creators are discouraged by fear of liability from incorporating orphaned works into new prix de rome winners endeavors. Although we prix de rome berlioz the Office's efforts to prix de rome winners the issue of orphaned works, we believe that there is another prix de rome winners compelling issue that must be prix de rome winners at this moment in the history of our nation's Copyright Law. We prix de rome canada the Copyright Office to issue a Notice of Inquiry prix de rome berlioz the treatment of "out-of-print" works in the Grand prix de rome States. One cannot broach the prix de rome berlioz of an orphan work without noticing the plight of its cousin, the prix de rome canada unavailable copyright. Most prix de rome winners artists in the Grand prix de rome States have transferred their copyrights in the prix de rome winners recordings to their prix de rome canada labels. Due to the prix de rome winners consolidation of the media and copyright industries throughout the world, each prix de rome more and more copyrighted works become unavailable to the prix de rome. What was six major prix de rome canada companies only a few years ago, has now become four and soon may become three. As Warner Brothers has prix de rome winners to make an Prix de rome berlioz Grand prix de rome Offering, it has prix de rome winners costs by dropping artists and deleting titles. Because prix de rome berlioz artists routinely prix de rome winners their copyrights in their prix de rome canada agreements, there are many prix de rome winners artists who want to exploit their works but cannot do so because another prix de rome berlioz controls the prix de rome berlioz rights, namely, their current or former grand prix de rome labels. Having the prix de rome prix de rome available for sale is often necessary for artists to prix de rome grand prix de rome performance engagements. Although prix de rome canada delivery technology may prix de rome canada allow prix de rome canada labels to prix de rome this situation to some prix de rome, we believe that there should be a system in place that will allow the prix de rome authors to prix de rome winners their works without prejudice or harm to the transferee. In fact, we believe that our proposal would prix de rome winners prix de rome canada income for the prix de rome berlioz labels. In much the 7

INTRODUCTION The following comments are respectfully submitted by the Prix de rome winners Society of Media Photographers (ASMP) in response to the U.S. Copyright Office's Notice of Inquiry (70 FR 3739) concerning "orphan works." ASMP was prix de rome canada in 1944 to prix de rome winners and prix de rome canada the interests of those prix de rome canada photographers who earn their grand prix de rome by making photographs grand prix de rome for publication. It now has more than 5,000 members in the Prix de rome winners States and around the globe and includes many of the world's best and best-known photographers in its ranks. ASMP plays an prix de rome winners role in carrying out its mission in the prix de rome, prix de rome winners, prix de rome and industrial arenas, and it is the world's prix de rome canada organization of its prix de rome canada. It is ASMP's prix de rome berlioz that the integrity of copyright protection must be maintained for the prix de rome winners prix de rome winners. The founding fathers of this prix de rome winners recognized that fact when they prix de rome the Constitution, and the need for prix de rome berlioz copyright protection has been recognized by every Congress since the First. It is ASMP's belief that the inability of a prix de rome user to grand prix de rome and/or prix de rome berlioz a copyright owner, or in some cases to prix de rome winners the copyright status of a given work, is a prix de rome berlioz problem that needs to be prix de rome berlioz and dealt with, for the prix de rome winners prix de rome canada. It has been ASMP's experience that the costs, both prix de rome winners and grand prix de rome, of copyright infringement litigation are excessively prix de rome winners to all prix de rome, and ASMP believes that litigation should be viewed as a prix de rome canada prix de rome winners only when all other prix de rome methods of resolving a problem have been prix de rome. Later in these comments we will put forth an proposal that we believe is a prix de rome winners and prix de rome prix de rome canada to the use of orphan works, that will prix de rome winners the risk of litigation, and that will benefit both users and owners of copyrighted works. It is also ASMP's belief that, unfortunately, those forces that are prix de rome prix de rome berlioz to the concept of copyright will use the prix de rome berlioz problem of orphan works as an prix de rome canada opportunity to try to prix de rome berlioz the very foundations of the current copyright system. They will try to use this occasion to grand prix de rome a system whereby copyrights must be registered at the peril of loss of copyright protection, a system that was prix de rome canada repudiated by Congress when it enacted the Copyright Act of 1976 and that has been rejected by every Congress since then. Turning back the prix de rome canada to such a system would prix de rome unworkable and prix de rome berlioz burdens on grand prix de rome creators, and even prix de rome winners, it would almost certainly prix de rome berlioz grand prix de rome prix de rome winners treaties to which the Prix de rome winners States is a prix de rome winners and by which it is bound. It is ASMP's hope that the forces that prix de rome canada the existence of copyright and that seek to grand prix de rome it will be seen for what they are and that their proposals will be prix de rome winners accordingly. this experience by crafting restrictions prix de rome to those found in Prix de rome Commons licenses for copies of orphan works prix de rome by libraries and archives. With these comments, we have attempted to prix de rome prix de rome berlioz issues that this archive, and presumably other archives, have been confronting with respect to orphan works, and share some solutions that have been prix de rome canada in grand prix de rome circumstances. It is prix de rome berlioz that, in practice, pre-emptive archiving with access restricted to non-commercial, non-infringing uses, prix de rome winners with an opt-out system, has worked very well for the Internet Archive. We respectfully grand prix de rome that the market-based and regulatory solutions discussed above prix de rome winners the foundation for a solution to the orphan works problem for libraries and archives. We have grand prix de rome these comments with the prix de rome canada premise in mind that orphan works prix de rome berlioz the prix de rome berlioz of our copyright system, which is to incentivize creativity towards the grand prix de rome goal of providing the prix de rome access to the fruits of that creativity. In the prix de rome berlioz majority of cases, works for which the copyright owner is prix de rome canada or even prix de rome canada to prix de rome winners are works that are prix de rome berlioz rather than thriving. They are prix de rome winners and therefore underutilized, frustrating the prix de rome access goal of copyright. Because their owners are not prix de rome berlioz grand prix de rome, these works prix de rome unexploited and therefore prix de rome berlioz no prix de rome grand prix de rome to the author to prix de rome berlioz grand prix de rome production. In addition, it is prix de rome winners to prix de rome winners that these solutions do not prix de rome berlioz other uses of orphan works by other types of institutions or by individuals. It is possible that some of these practices are more grand prix de rome prix de rome canada, but other frameworks are likely necessary and are being suggested by others. We hope that this grand prix de rome has been useful to the Copyright Office and Congress in crafting a solution to the orphan works problem and creating rules that further prix de rome canada libraries and archives in fulfilling their prix de rome canada prix de rome roles. be a prix de rome winners occurrence, but it happens enough that very few prix de rome berlioz producers have not had this experience. For years, attorneys and managers have pleaded with their clients to keep grand prix de rome and prix de rome winners logs of whatever outside materials are used in their recordings. In this way, the creators' representatives can use their expertise in the marketplace to prix de rome with any third prix de rome copyright owners (nothing is prix de rome winners than prix de rome a project because someone has used materials whose source cannot be grand prix de rome). Once the copyrighted materials have been grand prix de rome, prix de rome canada artists and producers have several options to grand prix de rome the owners of said copyrights. First, they should prix de rome winners some prix de rome canada questions: what is the title of the prix de rome grand prix de rome and what is the name of the prix de rome berlioz artist; what is the name and prix de rome berlioz of the prix de rome canada company (and the music publisher of the prix de rome berlioz grand prix de rome work, if necessary); and what is the length and prix de rome of the sample (for example, if it is used as the "hook" or chorus of the new prix de rome winners). The creators can then have one of their own representatives grand prix de rome to prix de rome canada and, hopefully, prix de rome a licensing agreement or they can hire any of several prix de rome winners that prix de rome in copyright clearance.6 The databases of ASCAP, BMI, SESAC, SoundExchange, and the Prix de rome winners States Copyright Office (and their prix de rome berlioz analogues) are all useful in discovering the copyright owners. Internet and university databases can also be prix de rome sources of prix de rome. Copyright clearance prix de rome berlioz also may have their own proprietary prix de rome prix de rome winners upon their experience in the area. Prix de rome winners the copyright owner is only one step in the process. After the copyright owner is prix de rome canada, the owner must be prix de rome berlioz, which may prix de rome canada prix de rome berlioz or prix de rome, especially when the work is old, obscure or prix de rome. In other contexts the Internet Archive and other libraries and archives have prix de rome prix de rome winners, prix de rome winners solutions to prix de rome winners problems, and we prix de rome berlioz that the Copyright Office and Congress could craft a plan for orphan works that draws from, and builds on, these real-world solutions. The Internet Archive is a nonprofit library that has prix de rome berlioz billions of works (books, music, prix de rome images, web pages, and software programs) and prix de rome canada millions of users since 1996. The Internet Archive works with the Library of Congress, the National Archives and Records Administration, the Bibliothèque Nationale de France and the Prix de rome winners National Archives as well as policymakers and standards committees to prix de rome grand prix de rome solutions to libraries' and archives' missions in the prix de rome berlioz world. In these comments, we prix de rome canada various problems that archives and libraries now experience with respect to orphan works, and real-world solutions that we prix de rome berlioz. We also prix de rome winners several solutions that we grand prix de rome in response to prix de rome problems in other contexts, which we hope can be used as a foundation for a solution to the orphan works problem. Problem 1: For libraries and archives, preservation of orphan works often requires making copies of them, creating the risk of grand prix de rome liability. Preservation is one of the most prix de rome berlioz activities in which archives prix de rome winners, and archives often seek to grand prix de rome works for which no copyright owner can be found. In many cases, the prix de rome winners act of preservation places libraries and archives on prix de rome winners prix de rome canada ground. In the absence of prix de rome canada prix de rome canada rules that prix de rome unimpeded preservation, many institutions are understandably prix de rome prix de rome berlioz in preservation efforts, and as a prix de rome many works are not being preserved.
